Revised merger notification thresholds

Following a public consultation reviewing certain provisions of the Competition Act 2002, the Department of Business, Enterprise and Innovation has issued a Ministerial Order revising the financial thresholds at which notification of a merger or acquisition to the Competition and Consumer Protection Commission (CCPC) is required.

From 1 January 2019, undertakings will be obliged to notify the CCPC when:

  • The aggregate turnover in the State of the undertakings involved is not less than €60,000,000 and;
  • The turnover in the State of each of 2 or more of the undertakings involved is not less than €10,000,000
