Compliance Notice - Tongali Trading Limited T/A Ciaran O'Flynn Jewellers

Tongali Trading Limited, being a trader for the purposes of the 2007 Act and being a trader to which Regulation 7 of the 2019 S.I. applies, on 11 November 2025 engaged in a prohibited act or practice (as defined in section 67(e) of the 2007 Act by failing to display at Ciaran O’Flynn Jewellers, Unit 14, Dungarvan Shopping Centre, Dungarvan, Co. Waterford, X35 N720 (the “Premises”), a notice, in the form set out in the Schedule to the 2019 S.I. (in contravention of Regulation 7 of the 2019 S.I.).

The CCPC found the trader who supplies an article of precious metal from their premises to which the public has access, in breach of failing to exhibit a notice in the form set out in the Schedule to the relevant legislation in a position so as to be clearly visible and easily accessible to a consumer before or immediately after entering the premises as required by Regulations 7 and 8 of the relevant legislation.

The CCPC served a Compliance Notice on the trader, which took effect on 03 April 2026, directing Tongali Trading Limited, a trader, to display a notice in the form set out in the Schedule to the 2019 S.I. (in accordance with Regulation 7 of the 2019 S.I) at their Premises and to display it in accordance with the requirements of Regulation 8 of the 2019 S.I.

S.I. No. 442 of 2019 Article of Precious Metals Regulation 7 requires that this notice must be located in a position so as to be clearly visible and easily accessible to a consumer before or immediately after entering the premises, be displayed on not less than A4 size paper, and contain letters and figures at least three millimetres in height and of proportionate width, which are not hidden, obscured, or interrupted by other pictorial or written matter.
