CCPC submission to the Environmental Legal Costs consultation

In June 2024 the CCPC was invited to make a submission to assist with the ongoing work of the Interdepartmental Group on Environmental Legal Costs.
We made observations on the system of regulating costs in judicial review proceedings, as then set out in the Planning and Development Bill 2023, which included the need to ensure measures prescribing legal costs meet the objectives of promoting access to justice while retaining competition between legal practitioners and a recommendation to mandate the collection and publication of price data for legal practitioners to mitigate the risk of potential anti-competitive conduct.
The submission also recommended that lawyers be remunerated under the proposed regulations based on an assessment of work done, rather than seniority.
