CCPC submission to Indecon and the Department of Justice on proposed options for control and reduction of litigation costs

In November 2022 the CCPC responded to the request from Indecon and the Department of Justice for a formal submission in respect of four proposed options for the control and reduction of litigation costs in Ireland. In its response the CCPC set out a number of issues it identified as relevant to the evaluation of all four of the proposed options, including information asymmetry and ‘moral hazard’ in client-legal practitioner relationships, the potential impact on competition with a particular emphasis on the risk of price co-ordination, the potential impact on innovation, the role of the Office of the Legal Costs Adjudicator in reducing litigation costs, the need for data collection on legal costs in Ireland and the importance of regular review of the fee scales set by any of the proposed options.
The CCPC also put forward observations specific to each of the four proposed options.
On 7 February 2024 the Multi-Criteria Impact Evaluation of Options for the Control of Litigation Costs prepared by Indecon for the Department of Justice which cites the submission of the CCPC, was published.
