VARIATION OF THE CO-OPERATION AGREEMENT DATED 11 NOVEMBER 2015 BETWEEN THE COMPETITION AND CONSUMER PROTECTION COMMISSION AND THE COMMISSION FOR COMMUNICATIONS REGULATION

SUPPLEMENTAL AGREEMENT dated the 19th day of July 2016

BETWEEN

  1. The Competition and Consumer Protection Commission of O. Box 12585, Dublin 1

AND

2. The Commission for Communications Regulation of Block DEF, Abbey Court,                         Irish Life Centre, Lower Abbey Street, Dublin 1.

WHEREAS

  1. The CCPC and ComReg are Parties to the Agreement.
  2. The CCPC and ComReg wish to vary the terms of the Agreement in the manner provided in this Supplemental Agreement.

NOW IT IS HEREBY AGREED

1. INTERPRETATION AND DEFINITIONS

In this Supplemental Agreement the following definitions shall apply:

“Agreement” means the co-operation agreement entered into between the CCPC and ComReg on 11 November 2015;

“CCPC” means the Competition and Consumer Protection Commission;

“ComReg” means the Commission for Communications Regulation;

“Party” means the CCPC and/or ComReg, and “Parties” shall be construed accordingly.

Clause 11 (Variation of the terms of the Co-operation Agreement) of the Agreement provides that the Agreement may only be varied with the consent of both Parties in writing.

In order to address a typographical error in the Agreement, the CCPC and ComReg have agreed to vary the Agreement in the manner provided for herein.

2. VARIATION OF THE AGREEMENT

In accordance with Clause 11.2 of the Agreement, the Parties agree that the Agreement is hereby varied such that the reference on page 1 of the Agreement to “section 19 of the Competition and Consumer Protection Act 2015” is deleted and replaced with a reference to “section 19 of the Competition and Consumer Protection Act 2014”.
