CCPC publishes Consumer Protection List 2023

The Competition and Consumer Protection Commission (CCPC) has published its annual Consumer Protection List 2023 (CPL) which details its consumer protection enforcement activities. The CPL contains the names and addresses of the relevant companies and individuals together with a description of the trade, business or profession and any other details the CCPC considers appropriate. In addition to the enforcement actions detailed in the CPL, the CCPC undertakes a range of activities to increase business compliance with consumer protection law.

During 2023, Authorised Officers of the CCPC conducted 183 consumer protection inspections, including 129 instore inspections, 43 online inspections and 11 vehicle trader inspections to assess businesses’ compliance with various pieces of legislation including Online Dispute Resolution, Consumer Rights Directive, and price display regulations and orders.

The information set out in the CPL includes:

Prosecution

A trader in Co. Limerick operating as a second-hand car dealer, was found to have engaged in a misleading commercial practice by misleading a consumer in relation to the mileage of a car. The trader was convicted, fined €2,000 and ordered to pay costs of €500 to the CCPC.

Compliance notices

A compliance notice (CN) is a written legal notice that the CCPC can issue to a trader who has committed, or is currently committing a prohibited act or practice.

A compliance notice directs the trader to stop a certain practice and obey the law by a certain date.

24 Compliance Notices were issued to traders in counties Clare, Cork, Dublin, Galway, Limerick, and Wexford for the following issues:

  • Misleading pricing: 4
  • Misleading consumers as to their rights: 11
  • Omitting or concealing important information from a consumer: 2
  • Not proving a link provided to the Online Dispute Resolution (ODR) platform: 7

Fixed payment notices

A Fixed Payment Notice (FPN) is a set fine of €300 that the CCPC can issue to traders for failing to correctly display prices accurately or failing to provide certain important information to a consumer.

52 Fixed Payment Notices were issued to businesses in counties Cavan, Cork, Dublin, Galway, Kildare, Kilkenny, Laois, Limerick, and Tipperary for the following issues:

  • Failing to indicate the selling price of a product: 39
  • Failing to display pricing in a licenced premises: 13
