They include mediation, arbitration and conciliation.\u00a0The process involves the use of an independent third party to help disputing parties reach a resolution on their issue.<\/p>\n<h4>What\u2019s New?<\/h4>\n<p>The\u00a0<a href=\"https:\/\/enterprise.gov.ie\/en\/legislation\/legislation-files\/european-union-alternative-dispute-resolution-for-consumer-disputes-regulations-2015.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">European Union (Alternative Dispute Resolution for Consumer Disputes) Regulations 2015 &#8211; S.I. No. 343<\/a> of 2015 and <a href=\"https:\/\/enterprise.gov.ie\/en\/legislation\/legislation-files\/si-368-of-2015.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">S.I. No. 368 <\/a>of 2015 &#8211; aim to promote the availability of high-quality and independent ADR processes to consumers, for both\u00a0domestic and cross-border disputes, and\u00a0both online and offline sales and services contracts. The Regulations\u00a0set out the requirements which a dispute resolution entity must fulfil to be listed\u00a0as an ADR entity\u00a0and specify\u00a0the information which a trader must make available to a consumer.\u00a0It is voluntary for dispute resolution entities to be listed under the Regulations and for traders to use these ADR entities.<\/p>\n<p>The CCPC\u00a0is now accepting notifications from entities wishing to be listed as an ADR entity under the Regulations.<\/p>\n<h4>Becoming\u00a0an ADR entity under the Regulations<\/h4>\n<p>A dispute resolution entity established in the State that wishes to become an ADR entity under the Regulations must notify the CCPC\u00a0using this <a href=\"https:\/\/www.ccpc.ie\/business\/wp-content\/uploads\/sites\/3\/2017\/04\/ADR-Notification-Form.pdf\">notification form<\/a>.<\/p>\n<p>The CCPC\u00a0must assess whether the entity:<\/p>\n<p>(a) qualifies as an ADR entity falling within the scope of the Regulations and<\/p>\n<p>(b) complies with the quality requirements.<\/p>\n<p>The CCPC\u00a0maintains a public list of ADR entities that have been notified to it and which fulfil\u00a0the requirements. \u00a0The list is available on this page.\u00a0For a list of all EU approved ADR entities, please click <a href=\"https:\/\/consumer-redress.ec.europa.eu\/site-relocation_en?event=main.adr.show\">here<\/a>.<\/p>\n<h4>Obligations for traders<\/h4>\n<p>The ADR Regulations create obligations for traders who commit to using, or are legally obliged to use an ADR entity to resolve disputes with consumers. Any such trader is obliged to provide consumers with the name and website of the ADR entity in the following ways:<\/p>\n<ul>\n<li>On the trader\u2019s website (where one exists);<\/li>\n<li>In the general terms and conditions of sales or services contracts.<\/li>\n<\/ul>\n<p>In addition, if a consumer has submitted a complaint directly to <strong>any<\/strong> trader which cannot be settled, the trader is obliged to provide the consumer, in writing, with the following information:<\/p>\n<ul>\n<li>The name and website of an ADR entity which covers that trader\u2019s sector;<\/li>\n<li>Confirmation of whether the trader is prepared to use that ADR entity to settle the dispute.<\/li>\n<\/ul>\n<p>A trader who fails to comply with these requirements can face a fine of \u20ac5,000, or imprisonment of up to 12 months, or both.<\/p>\n<h5>If you have a query on ADR, you can contact us:<\/h5>\n<p>By email:<a href=\"mailto:adr@ccpc.ie\"> adr@ccpc.ie<\/a><\/p>\n<p>By phone: +353\u00a01\u00a0402\u00a05500<\/p>\n<p>In writing to:\u00a0ADR Team, CCPC, Bloom House, PO Box 12585, Railway Street, Dublin 1,\u00a0D01 C576<\/p>\n<\/section>\n\n<\/div><h2 class=\"tabtitle\">List of ADR entities<\/h2>\n<div class=\"tabcontent\">\n\n<p>The following ADR entities have been notified to the CCPC to be listed in accordance with Regulation 8, and fulfil the conditions set in Regulation 7(3), of S.I. No. 343 of 2015, the CCPC publishes and sends to the European Commission a report on the development and functioning of ADR entities listed in Ireland every four years.
